This Privacy Policy sets out the rules for the processing of personal data by the data controller (hereinafter: “Controller”) provided via the contact form on the website https://www.meltemee.com and collected automatically via cookies.

Data processing in connection with the contact form

Source and scope of data

The controller processes personal data obtained directly from you when you contact us via the contact form available at https://www.meltemee.com. Identification data (e.g., first and last name), contact details (e.g., email address, phone number), as well as company name and position may be processed.

Purpose, basis, and period of personal data processing

The personal data you provide in the contact form is processed on the basis of the Administrator's legitimate interest (Article 6(1)(f) of the GDPR) for the following purposes:

  • handling your request and communicating with you, including responding to your questions or contacting you in connection with your request,
  • establishing, pursuing or defending claims that the Administrator may incur or that may be brought against it,
  • ensuring IT security in terms of monitoring electronic communications and preventing abuse.

Personal data will be processed for the period necessary to achieve the above purposes, i.e. until the end of the handling of the request or contact. After this time, the data may be further processed for the duration of the Administrator's legitimate interest, but no longer than 12 months from the completion of the request, unless an effective objection to such processing is lodged earlier. In the event of an ongoing dispute or proceedings (including court proceedings), the data will be processed until its final conclusion.

Voluntary provision of data

The provision of data is voluntary, but failure to provide it may prevent the request or contact from being processed.

Recipients of personal data

Access to personal data within the Administrator's organizational structure will be limited to authorized personnel and only to the extent necessary. Personal data may also be disclosed to:

  • entities providing services to the Administrator (e.g., IT service providers, hosting providers) – on the basis of data processing agreements,
  • public authorities – when required by applicable law.

Transfer of data outside the EEA

Your personal data may be processed outside the European Economic Area (EEA), mainly in the USA, in connection with the use of cloud services. The transfer of personal data may take place on the basis of:

  1. the European Commission's implementing decision of July 10, 2023, which confirms the adequate level of protection of personal data provided under the EU-U.S. Data Privacy Framework (DPF), in accordance with Article 46 of the GDPR,
  2. standard contractual clauses adopted by the European Commission on the basis of Article 46 of the GDPR – in cases where the recipient does not participate in the DPF.

Automated decision-making and profiling

Your data will not be subject to automated decision-making, including profiling.

Rights of data subjects

In accordance with the GDPR, you have the following rights:

  1. the right to access your personal data and obtain a copy thereof;
  2. the right to rectify (correct) or supplement your data;
  3. the right to erase your data (“right to be forgotten”) – in cases provided for by law;
  4. the right to restrict data processing;
  5. the right to object – at any time, for reasons related to your particular situation, to processing based on the legitimate interest of the Controller; the objection should include a justification;
  6. the right to object to the processing of data for direct marketing purposes – without the need to justify your decision;
  7. the right to lodge a complaint with a supervisory authority – in Poland, this is the President of the Personal Data Protection Office.
